3. DEEP LAWN, ONLINE ESTIMATING, AND PROPERTY MEASUREMENT
LOMAR may use Deep Lawn and/or similar third-party technology to support property measurement, estimating, pricing, lead intake, customer enrollment, service configuration, or related functions. Information you submit through an estimate or enrollment experience may be transmitted to or processed through the applicable platform as necessary to provide those functions.
These services may use property addresses, mapping data, aerial or satellite imagery, automated measurements, public information, artificial intelligence, customer-supplied information, and other property data to evaluate a property or generate an estimate. Automated property information may not always be complete or accurate, and LOMAR may verify or correct information as reasonably necessary to provide accurate pricing and services.
A third-party platform may process information under its own privacy terms in addition to processing information on LOMAR's behalf. We encourage users to review any privacy notice presented by a third-party platform during an estimate, enrollment, or other interaction.
4. GOOGLE ANALYTICS
LOMAR may use Google Analytics to understand website traffic, visitor interactions, and website and marketing performance. Google Analytics may collect information such as session statistics, approximate location, browser and device information, page URLs and titles, events, and identifiers stored through cookies or similar technologies.
We may use information from Google Analytics to evaluate website usage, improve our website and services, understand how visitors reach our website, and measure marketing effectiveness. Depending on LOMAR's configuration and the visitor's privacy choices, Google Analytics information may also be used with Google advertising services or related measurement features.
LOMAR does not intend to transmit information to Google Analytics that Google prohibits customers from sending as personally identifiable information. Website forms and analytics configurations should be maintained accordingly.
5. META PIXEL AND ADVERTISING TECHNOLOGIES
LOMAR may use the Meta Pixel and similar advertising or measurement technologies. These technologies may collect or receive information about visits to and interactions with our website, including browser or device information, pages viewed, actions taken, advertising identifiers, cookie information, and information used to measure whether an advertisement resulted in a website visit, estimate request, enrollment, or other action.
We may use these technologies to measure advertising effectiveness, create or evaluate audiences, understand customer acquisition, improve advertising, and, where permitted by applicable law and consistent with applicable privacy choices, support targeted or personalized advertising.
Meta and other advertising providers may process information according to their own terms and privacy policies. LOMAR does not control independent processing performed by those providers.
6. COOKIES AND SIMILAR TECHNOLOGIES
Our website may use cookies, pixels, tags, local storage, and similar technologies for website operation, security, preferences, analytics, measurement, and advertising. Some are provided by third parties such as Google, Meta, website-hosting providers, estimating platforms, and other technology vendors.
The availability and operation of browser controls, cookie settings, consent-management tools, advertising preferences, and similar privacy controls may depend in part on the technologies and third-party services used by LOMAR. Where applicable law requires LOMAR to provide or honor a particular privacy choice, LOMAR will take commercially reasonable steps to provide or honor that choice using methods reasonably available to LOMAR. Browser settings may also allow users to limit certain cookies or tracking technologies, although doing so may affect website functionality.
7. PAYMENT PROCESSING
LOMAR uses or may use a third-party payment processor to process online, recurring, or other electronic payments. Payment-card information may be collected directly by the payment processor rather than stored by LOMAR.
LOMAR may receive transaction information such as payment amount, date, payment status, transaction identifier, billing information, and limited payment-method information necessary to administer the customer account. The payment processor's collection, use, storage, and security of payment information may also be governed by its own privacy policy and terms.
8. HOW WE DISCLOSE INFORMATION
LOMAR may disclose information when reasonably necessary to operate our business, provide requested services, administer customer relationships, or fulfill the purposes described in this Policy. Categories of recipients may include:
- website hosting, software, security, and technology providers;
- Deep Lawn and other estimating, mapping, aerial-imagery, measurement, and property-data providers;
- Google and other analytics or measurement providers;
- Meta and other advertising, marketing, or campaign-measurement providers;
- payment processors and billing providers;
- customer relationship management, scheduling, routing, and communication providers;
- email and text-message providers;
- accounting, bookkeeping, insurance, legal, and other professional advisers;
- employees, contractors, and subcontractors assisting with authorized services;
- governmental, regulatory, judicial, or law-enforcement authorities when required or permitted by law; and
- a purchaser, successor, lender, adviser, or other appropriate party in connection with a merger, acquisition, financing, restructuring, sale of assets, or similar business transaction.
Service providers may receive information as reasonably necessary to perform services for LOMAR, subject to applicable contractual and legal requirements.
9. SALE, SHARING, AND TARGETED ADVERTISING
LOMAR does not sell personal information for monetary consideration. However, our use of advertising pixels, cookies, and related technologies may involve disclosure of online identifiers, device information, website activity, or similar data to advertising or analytics providers. Depending on the law that applies to a particular user, some of these activities may be characterized as “sharing,” “targeted advertising,” or another regulated form of processing even when LOMAR receives no money for the information.
Where applicable law grants a right to opt out of targeted advertising, sale, sharing, or other regulated processing, LOMAR will provide or honor the applicable choice through a method reasonably available to LOMAR and appropriate to the technology involved. The specific mechanism may vary as LOMAR's website, service providers, and legal obligations change. LOMAR does not represent that every third-party platform, browser, or technology supports every privacy-control signal or preference unless LOMAR expressly states otherwise.
10. COMMUNICATIONS
LOMAR may use your contact information for service-related communications concerning estimates, appointments, schedules, weather delays, property conditions, account activity, payments, renewals, cancellations, and other matters relating to your customer relationship.
We may separately send promotional or marketing communications where permitted by law. You may opt out of promotional email communications through the unsubscribe mechanism in the communication. Opting out of promotional communications does not prevent non-promotional communications necessary to administer your services or account.
Text messaging, if offered, may be subject to additional disclosures, terms, or consent requirements presented when you enroll or provide consent.
11. PHOTOGRAPHS AND SERVICE DOCUMENTATION
LOMAR may take photographs or other exterior documentation of a service property for legitimate operational purposes, including:
- documenting property conditions and completed work;
- documenting inaccessible areas, pet-waste conditions, pre-existing conditions, or damage;
- investigating service concerns, complaints, or claims;
- quality control and training; and
- other matters reasonably related to providing or documenting services.
Operational photographs are not automatically authorized for public advertising or promotional use merely because they were taken for service documentation. Where separate permission is legally required for a particular marketing use, LOMAR will obtain the required permission.
12. DATA SECURITY
LOMAR uses reasonable administrative, technical, and physical safeguards appropriate to the nature and volume of information we maintain. We also rely on third-party providers to maintain appropriate safeguards for information they process on our behalf. No method of electronic transmission or storage can be guaranteed to be completely secure, and LOMAR cannot guarantee absolute security.
13. DATA RETENTION
LOMAR retains personal information for as long as reasonably necessary for the purposes for which it was collected, including providing services, maintaining customer and business records, processing transactions, resolving disputes, enforcing agreements, complying with legal, tax, insurance, and accounting requirements, and protecting legitimate business interests. Retention periods may vary depending upon the information and applicable legal or business requirements.
14. YOUR PRIVACY CHOICES AND RIGHTS
Depending upon where you reside and applicable law, you may have rights concerning your personal information, which may include the right to:
- confirm whether certain personal data is being processed and access that data;
- correct inaccuracies;
- request deletion of certain personal data;
- obtain a copy of certain personal data;
- opt out of targeted advertising, sale, or certain profiling where applicable; and
- appeal certain decisions concerning a privacy request where applicable.
These rights are subject to applicable legal exceptions and may not apply in every circumstance. LOMAR may take reasonable steps to verify your identity before processing a request.
To submit a privacy request or exercise an applicable opt-out right, contact LOMAR using the information in Section 19 or use any privacy-choice mechanism made available on our website. If applicable law provides a right to appeal LOMAR's decision, you may use the same contact method and identify the request as a “Privacy Request Appeal.”
LOMAR will not unlawfully discriminate against a consumer for exercising an applicable privacy right.
15. THIRD-PARTY WEBSITES AND SERVICES
Our website may contain links to or integrations with third-party websites, platforms, or services. LOMAR does not control the privacy practices of independent third parties. Information you provide directly to a third party may be governed by that third party's privacy policy. We encourage you to review the privacy notices of third-party services you use.
16. CHILDREN'S PRIVACY
LOMAR's website and services are intended for adults seeking landscaping, lawn-care, or grounds-maintenance services and are not directed to children under 13. LOMAR does not knowingly solicit personal information online from children under 13. If we learn that we have collected personal information from a child in circumstances requiring parental consent, we will take appropriate steps consistent with applicable law.
17. LEGAL DISCLOSURES
LOMAR may preserve or disclose information when reasonably necessary to:
- comply with applicable law, regulation, subpoena, court order, or other legal process;
